Abstract

The European Union is founded on a set of common principles of democracy, the rule of law, and fundamental rights, as enshrined in Article 2 of the Treaty on the European Union, and union member states must abide by these principles. Because the EU in not a state, this make very difficult for the EU to observe and punish member states for the violations of EU principles and values .This research seeks to answer questions related to how the European Union deals with member states violation of the rule of law principle, while the judicial power deals with this breach in federal state as in the United State of America, EU depends on  Article 7 of the Treaty of the EU(TEU) which allows it to discipline a state when there is a serious breach” of  values. The Article 7 of TEU procedure was enforced in two cases so far; in December 2017 in case of Poland (by the commission).
