Abstract

Due to the fact that the discrimination based on gender, religion or color, or any other similar thing is considered a discrimination that the states can exceed, contrary to the discrimination based on the nationality bond; because, for them, it`s a discrimination that is considered as a matter of existence or not. Hence, the importance of the research shows the extent that nationality bond as related to the special role in assigning the denotation of (the foreigner), especially as related to the states that are able to establish bonds that exceed the limits of nationality bond - if it is a true expression - such as the Arab countries, in what they possess of historical constituents that established for the existence of a link (Arab nationality). This necessitates to wonder about the role of these constituents in taking out the (Arabian) from the traditional concept of foreigners and the extent of harmony this role has - if any- with the logic of the legal texts, and the extent of its ability to actually applicability in balanced way (First Chapter).

 

 

From the difference of the Arab countries in locating the denotation of the (foreigner), and the difference of their policies against its legal position, as a whole in what it comprises of rights, including its political rights, the importance of the research also shows its attitude from the matter of ratifying these rights to observe
