Abstract

It is recognized by Jurisprudence, Jurisprudence and law that the public works contract is governed by a general principle that the contractor contracting with the administration is obligated to carry out his contractual obligation personally and by himself, therefore he may not assign these obligations to third parties except after obtaining the approval of the administration, if the contractor waives his contract without obtaining the latter's approval, this waiver shall be considered null and shall not be invoked against it, and constituted a serious contractual error that justifier the administration's imposition of the harshest penlties on him.the obligation of the contractor to the implement the contract personally is, in most cases, an obligation to achieve the a result, and not to taka care.
