Abstract

In this research, we discuss the principle of impartiality of a member of the Disciplinary Council as one of the disciplinary guarantees in the public office. The study aimed to show that there is no comprehensive and anti-impartial definition of the principle of impartiality. Personal and objective, and its limits vary according to the legal system followed in the country, there is the administrative disciplinary system, the judicial system, and the quasi-judicial system, and there are several legal means to ensure the protection of the principle of impartiality, including the possibility of applying some of the reasons for the dismissal and dismissal of judges stipulated in the Code of Civil Procedure or in the procedural laws The subject of the research is on a member of the Disciplinary Council, and the possibility of applying the defect of abuse of power to a member of the Disciplinary Council, especially in the administrative disciplinary system.
