Abstract

The idea of higher legal rules than others which it is not permissible to deviate from them, formed a part that cannot be separated from legal theory in general, peremptory norms in international law are considered as the general order in domestic law, as peremptory norms nullify everything that conflicts with them and are superior to other rules of international law. even Circumstances precluding wrongfulness cannot legitimize an act that violates a peremptory norm.

This importance of peremptory norms leads to questions about the conditions of these rules and standards, with which an international rule can rise to the level of peremptory norms?
