Abstract

The study concludes that warranties for parliamentary independence are extremely important and expensive. They are not limited to warranties that are decided for a council and its members once it has been formed and has embarked on its activities, but rather start from well before the candidature process. Warranties for parliamentary independence start with incorporating some constitutional and legal principle that guarantee the integrity of the parliamentary system into the legal system of the State. These warranties also encompass the equitable distribution of constituencies and the appointment of a supervisory body to oversee the election process. Once the elections have been completed, many warranties should be decided for the elected parliamentary council and its members, mainly entrusting the Judiciary Power with competence to settle matters regarding the validity of membership to the council and the allowing the elected parliament to exercise its actual competences without interference from the Executive Power. These councils should also be independent administratively and financially. Administrative independence is achieved when the council enjoys complete independence in enacting its own statutes and exercise its right to withdraw membership from, and inflict disciplinary action against its own members. Financial independence is achieved through the Council's freedom in organizing its own budget. Therefore, we will try through this research to shed light on the Warranties granted to achieve the independence of the parliamentary councils in order to shows the most important consequences and suggestions.
