Problems of the Unified Policy in resolving domains name disputes

Abstract

DOMAIN NAMES are key element in e-life , it's importance increased due to the increase of the interest in registering  them specially in the commercial web sites , As a result of this interest, these competing names have led to disputes that have mainly occurred  between trademark owners and domain name holders .

Despite the significance of domain names and the increasing number of  conflicts related to them, it was not regulated in a separate  law in most countries of the world, which led to the application of general rules of trademark law, this also led the parties to seek an alternative alternative solution to settle the domain name dispute  by applying the uniform domain name dispute resolution .

This study examines in detail the UDRP and its rules as the alternative  resolution system for the domain names disputes arising from the registration and use of domain names, specifically the kind of disputes between trademarks and domain names, it also highlights the policy shortcomings and its  inability to protect DOMAIN NAMES , personal names and intellectual property rights other than trademarks.

as a conclusion this study suggests amendments to the UDRP so it would include and protect all rights against domain names instead of  restricting this protection to trademarks
