Abstract

The nuclear arms race has given tremendous power to the military presence at sea, considering the importance of the seas in strategic, economic and military terms, as well as the emergence of some mechanisms and the emergence of many modern and advanced possibilities for the exploration and exploitation Mineral Resources found in the seas, he had a role in the emergence of political and military problems that threaten international peace and security, it is known that there are many specialized marine vehicles originally intended for peaceful purposes that can perform military purposes in time of war, such as oil and gas pipelines.

Therefore, it was necessary to keep the maritime areas away from military uses and limit them to activities for peaceful purposes, however, this was difficult to implement in light of the attempt of the major maritime countries to maintain their military presence to protect their interests and influence.

Accordingly, it was necessary to discuss the early stages of the emergence of the principle of the peaceful use of the seas, how to regulate it through international treaties, and then sail the operation practiced by the coastal state, which constitute a violation of the principle of the peaceful use of the seas.
