The lawsuit against the judges is the last means that the litigants resort to in order to protect their rights from the bad faith or negligence of the judges.
It seems to us that the jurisprudence in Syria did not distinguish between substantive and formal conditions in the case of disputing judges. In addition, the poor judicial foundation of the dispute case against judges led to conflicting jurisprudence regarding it.
It is noted that the judicial jurisprudence in Syria has been keen to harass the litigants in filing a dispute lawsuit on the grounds that it harms the reputation of the judiciary more than its keenness to protect the interests of the litigants and achieve justice among them.
