Abstract

The research aims to establish a jurisprudential foundation for the mixing of funds in Syrian Islamic banks, and to explain the jurisprudential problems facing Syrian Islamic banks in investing their own funds and depositors’ funds in a common pool. The research also aims to address the problems of distributing allocations and reserves after the funds are mixed with each other, and in order to achieve the previous objectives. The research was divided into two sections: The first dealt with the forms of mixing funds in Syrian Islamic banks, and the second included the effect of mixing funds in the distribution of allocations and reserves therein, Among the most prominent results of the research are: The issue of mixing investment accounts with each other and mixing them with the bank’s own funds is permissible with certain restrictions mentioned by jurists, and it is true in the nature of Syrian Islamic banking. The principle of allocations and reserves is also one of the most prominent matters in which rights are mixed, and the reason for mixing the rights of shareholders and depositors in allocations and reserves. It is the mixing of funds within the framework of Syrian Islamic banking.
